This California Privacy Notice supplements our Privacy Policy and applies solely to California residents ("consumers" or "you"). This notice is provided pursuant to the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA).

This notice describes your rights under California law and explains how you can exercise those rights. We are committed to transparency about our data practices and to honoring your privacy choices.

2. Categories of Personal Information We Collect

In the preceding 12 months, we have collected the following categories of personal information from consumers:

3. Sources of Personal Information

We collect personal information from the following sources:

  • Directly from you: When you register, create content, update your profile, or communicate with us
  • Automatically: Through cookies, device identifiers, and similar technologies when you use our services
  • Third-party platforms: When you sign in via Google OAuth
  • Payment processors: Transaction confirmation from Stripe (we do not receive full payment card details)

4. Purposes for Collecting Personal Information

We collect and use personal information for the following business and commercial purposes:

  • Providing, maintaining, and improving our location-based social platform
  • Processing your account registration and managing your account
  • Displaying location-based content ("Shouhts") and connecting you with nearby users
  • Processing subscription payments and managing premium features
  • Sending push notifications about nearby activity, replies, and mentions
  • Operating our gamification system (XP, levels, achievements, Rizz currency)
  • Enforcing our Terms of Service and Community Guidelines
  • Detecting, preventing, and responding to fraud, abuse, or security incidents
  • Complying with legal obligations
  • Displaying advertisements for eligible non-premium users, with personalized advertising only when you have not opted out

6. Sale and Sharing of Personal Information

We Do Not Sell Your Personal Information

Shouht does not sell personal information as defined under the CCPA. We have not sold personal information in the preceding 12 months and do not intend to sell personal information.

Sharing for Cross-Context Behavioral Advertising

We may share certain identifiers and internet activity information with advertising partners (Google AdMob/AdSense) for the purpose of displaying personalized advertisements when you have not opted out. Under the CCPA, this may constitute "sharing" for cross-context behavioral advertising purposes. If you opt out, eligible ad placements use non-personalized or contextual ads instead.

To opt out of personalized advertising:

  • Turn on Do Not Sell in Shouht privacy settings
  • Disable Advertising Cookies in your cookie preferences
  • Use a browser that sends a Global Privacy Control signal, which we honor as a web opt-out
  • Use your device's privacy settings to limit ad tracking
  • Use Google AdMob privacy choices when they are shown in the mobile app
  • Subscribe to Shouht Premium for an ad-free experience

7. Your California Privacy Rights

As a California resident, you have the following rights under the CCPA:

Right to Know

You have the right to request that we disclose:

  • The categories of personal information we collected about you
  • The categories of sources from which we collected your personal information
  • The business or commercial purpose for collecting or sharing your personal information
  • The categories of third parties with whom we share your personal information
  • The specific pieces of personal information we collected about you

Right to Delete

You have the right to request that we delete personal information we collected from you, subject to certain exceptions. You can delete your account and associated data through Settings → Account → Delete Account in the app.

Right to Correct

You have the right to request that we correct inaccurate personal information. You can update most of your information directly in the app settings.

Right to Opt-Out of Sharing

You have the right to opt out of the sharing of your personal information for cross-context behavioral advertising. See Section 6 above for opt-out methods.

Right to Limit Use of Sensitive Personal Information

We only use your precise geolocation (sensitive personal information) for the purposes of providing our location-based services, which you have consented to. You can disable location services at any time through your device settings.

Right to Non-Discrimination

We will not discriminate against you for exercising your privacy rights. We will not deny you goods or services, charge you different prices, provide a different quality of service, or retaliate against you for exercising your rights.

8. How to Submit a Request

To exercise your rights under the CCPA, you may submit a verifiable consumer request by:

  • In-App: Go to Settings → Account → Privacy Requests
  • Email: Send your request to [email protected]
  • Account Deletion: Settings → Account → Delete Account

You may only submit a request to know or delete twice within a 12-month period. The request must provide sufficient information to verify you are the person about whom we collected personal information and describe your request with enough detail for us to understand, evaluate, and respond.

9. Verification Process

We will verify your identity before fulfilling your request. This typically involves:

  • Confirming your email address matches our records
  • Sending a verification code to your registered phone number
  • For account deletion: confirming your username and password

If we cannot verify your identity, we may deny your request. We will not fulfill requests for specific pieces of personal information unless we can verify your identity to a reasonably high degree of certainty.

10. Authorized Agents

You may designate an authorized agent to make a request on your behalf. To do so, you must:

  • Provide the agent with written permission to submit the request
  • Verify your own identity directly with us
  • Confirm that you have authorized the agent to act on your behalf

We may deny a request from an agent if they cannot provide proof of authorization.

11. Response Timing

We will respond to verifiable consumer requests within 45 days of receipt. If we need additional time (up to 45 more days), we will notify you of the extension and explain the reason.

Any disclosures we provide will cover the 12-month period preceding your request. If we cannot comply with a request, we will explain why.

12. Data Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by law. For specific retention periods, please see our Privacy Policy.

When you delete your account, we remove your personal information from our active systems. Some information may be retained in backup systems for up to 30 days, and certain records may be retained longer for legal compliance.

13. Children's Privacy

Shouht does not knowingly collect personal information from California residents under 16 years of age. Our service requires users to be at least 13 years old, and we collect date of birth to verify age eligibility.

We do not sell or share for cross-context behavioral advertising the personal information of consumers we know to be under 16 years of age.

14. Changes to This Notice

We may update this California Privacy Notice from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this notice and, where appropriate, through the app or via email.
